Terms & Conditions of Membership

It is important that all new members read, understand and agree to our terms and conditions of membership before joining. I know, you have read something, but in the end it's to everyone's benefit ;)

By joining Songsalive! you agree to the following terms and conditions:

Member Services: Membership is a term used for clients of Songsalive! who receive services, promotion, support, resources and education such as attendance to songwriting workshops, special promotions, showcase opportunities, a regular newsletter, advice and consultancy, discounts and opportunities to promote their music. However Songsalive! is not obliged to be either limited to or strictly adhere to services and programs listed as part of its services to Members. Our current list of membership services are listed under our about page.

Membership does not guarantee eligibility or availability of Member Services. Members will be notified of meetings and workshops taking place through eNOTES! and Songnotes!, the regular newsletters. It is at the member's discretion if they actively pursue the opportunities, services and education which Songsalive! offers, through our announcements and website portal (including backstage), but Songsalive! is not obliged to ensure they receive the proper notification.

Membership is for one person only. It cannot be shared by a band, group or company. Each person from these need to join separately.

Dues:  The current Membership dues are U.S$50.00/AUS$60.00 for general membership and U.S$100/AUS$120 for Elite membership. Renewal fees are offered at a discount. Read the differences in membership here (pop up window)

Renewal: Membership expires in 12 calendar months.  Membership must be renewed by the specified start date; otherwise, the Member is subject to cancellation and all services are discontinued.  If you need extra time renewing your membership, please contact us for an extension. Please be aware that if you choose Paypal when originally joining, you will be set up on an auto-subscription which means that your account will be automatically debited each year. You can stop the subscription any time by logging into your paypal account (once first payment is made to join) and stopping the auto subscribe feature. We have found it easier for our membership department, and members have found it easier, to be automatically renewed each calendar year. Again, you can choose to turn this feature off after you've made the first payment.

Cancellation: Members are welcome to cancel their membership at anytime; however, in doing so; they will not be refunded any money for Membership dues and/or cancelled Member Services.  Songsalive! may modify or discontinue its Services, with or without notice, without liability to you, any other user, or any third party. Songsalive! reserves the right to terminate your membership or subscription if it learns that you have provided false or misleading registration information, interfered with other users, or members, or the administration of Songsalive!'s services, or violated these Terms and Conditions of Membership.

Liability:  Songsalive! Inc and its employees assumes no liability for the use of any information posted on our web site, or through any promoted articles by us, or through any program or service described or not described in our Membership Application Form, or through any participation in an event on a third party property, including but not limited to a showcase venue or club, or workshop/seminar/conference location. In no event will Songsalive! or its employees, agents, suppliers, members or contractors be liable for any damages of any kind or character, including without limitation any compensatory, incidental, direct, indirect, special, punitive, or consequential damages, loss of use, loss of data, loss of income or profit, loss of or damage to property, claims of third parties or other losses of any kind or character.

You agree to use our services/membership at your own risk. Our services are provided on an "as is" and "as available" basis. You agree that you have made your own determination regarding the usefulness of the service. We disclaim all warranties including, but not limited to, warranties of merchantability and fitness for a particular purpose.

We are not liable for damages, direct or consequential, resulting from your use of the service/membership, any failure to provide service, suspension of service, or termination of service. We do not guarantee the availability of the service. You agree not to hold us responsible for data loss or interruption of service of any kind.

We retain ownership and all rights to Songsalive! logos, trademarks, software, trade secrets, databases, reports, and Web site.

You may print and download portions of material from this site. We retain ownership and all rights to Songsalive! logos, trademarks, software, trade secrets, databases, reports, and Web site.

You also grant to Songsalive! the right to use your name in connection with the submitted materials and other information as well as in connection with all advertising, marketing and promotional material related thereto. You agree that you shall have no recourse against Songsalive! for any alleged or actual infringement or misappropriation of any proprietary right in your communications to Songsalive!.

YOU AGREE TO DEFEND, INDEMNIFY AND HOLD US HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, LIABILITY COSTS AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEY'S FEES) ARISING FROM YOUR VIOLATION OF THIS AGREEMENT OR ANY THIRD-PARTY'S RIGHTS, INCLUDING BUT NOT LIMITED TO INFRINGEMENT OF ANY COPYRIGHT, VIOLATION OF ANY PROPRIETARY RIGHT AND INVASION OF ANY PRIVACY RIGHTS. THIS OBLIGATION SHALL SURVIVE ANY TERMINATION OF THIS AGREEMENT. OUR LIABILITY WILL NOT EXCEED THE PURCHASE PRICE OF THE SERVICES/MEMBERSHIP.

This Agreement will be construed and enforced in accordance with the laws of California U.S.A and NSW Australia, without regard to its conflict of law principles. Venue for any dispute under this Agreement will be California. U.S.A or NSW Australia
